Agreement to Terms

Welcome to AIPhotoMaker ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at aiphotomaker.cloud and all related services (collectively, the "Service").

• "Payment" refers to any fees charged for premium services

2. Use of Service

2.1 Eligibility

You must be at least 13 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement.

2.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Service for personal or commercial purposes in accordance with these Terms.

2.3 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload or process illegal, harmful, threatening, abusive, or offensive content
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload photos without proper authorization or consent
• Use the Service to create fake or fraudulent documents
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Reverse engineer or attempt to extract source code
• Resell or redistribute our services without authorization

3. User Content and Intellectual Property

3.1 Your Content

You retain all rights to the photos and images you upload ("Your Content"). By uploading Content to our Service, you grant us a limited license to:

• Process and edit your images as per your instructions
• Store your images temporarily for processing purposes
• Display processed images to you for preview and download

We do not claim ownership of Your Content. All processed images belong to you.

3.2 Content Responsibility

You are solely responsible for Your Content and the consequences of uploading it. You represent and warrant that:

• You own or have necessary rights to upload the Content
• Your Content does not violate any laws or third-party rights
• Your Content does not contain viruses or malicious code

3.3 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by AIPhotoMaker and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

4. Payment and Pricing

4.1 Pricing

Certain features of our Service require payment. Current pricing:

• Passport Photo (12 photos - 4×6 inch): ₹5
• Passport Photo (8 photos - 6×4 inch): ₹5
• Passport Photo (30 photos - A4): ₹10
• Passport Photo (42 photos - A4): ₹10

Prices are subject to change with notice on our website.

4.2 Payment Processing

All payments are processed securely through Razorpay. We do not store your payment information. By making a payment, you agree to Razorpay's terms and conditions.

4.3 No Refund Policy (With Exceptions)

Due to the digital nature of our service, payments are generally non-refundable. However, we may issue refunds in the following cases:

• Technical failure preventing service delivery
• Poor quality output due to our error
• Duplicate charges
• Service not delivered within 24 hours

Refund requests must be submitted within 7 days to refunds@aiphotomaker.cloud.

4.4 Free Services

Some features (like background removal preview) are provided free of charge. We reserve the right to modify or discontinue free services at any time.

5. Service Availability and Modifications

5.1 Availability

We strive to provide 24/7 service availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or technical issues.

5.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

5.3 Updates

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

6. Data Storage and Privacy

Our handling of your data is governed by our Privacy Policy. Key points:

• Uploaded images are stored temporarily and deleted within 24 hours
• We do not permanently store your photos
• All data transmission is encrypted (HTTPS/SSL)
• We do not sell your data to third parties

7. Disclaimers and Warranties

7.1 Service "As Is"

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties of uninterrupted or error-free service

7.2 No Guarantee of Acceptance

We do not guarantee that photos created using our Service will be accepted by government agencies, passport offices, or other institutions. Users are responsible for verifying requirements.

7.3 AI Limitations

Our AI-powered features (background removal, enhancements) may not be 100% accurate. Results may vary based on image quality and complexity.

8. Limitation of Liability

To the maximum extent permitted by law, AIPhotoMaker and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your data
• Damages resulting from service interruptions or errors
• Rejection of photos by third-party institutions

Maximum Liability: Our total liability shall not exceed the amount you paid for the service in the past 12 months, or ₹100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless AIPhotoMaker and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded to the Service

10. Termination

10.1 By You

You may stop using the Service at any time.

10.2 By Us

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior
• Any reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that should survive termination (payment obligations, disclaimers, limitations of liability) will remain in effect.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.

11.3 Arbitration

For disputes under ₹10,000, parties agree to first attempt resolution through good faith negotiation. If unsuccessful, disputes may be resolved through binding arbitration.

12. Third-Party Services

Our Service uses third-party services including:

• Razorpay: Payment processing
• Remove.bg: Background removal API
• Google Analytics: Website analytics
• Google Adsense: Advertising

Use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

13. Miscellaneous

13.1 Entire Agreement

These Terms constitute the entire agreement between you and AIPhotoMaker regarding the Service.

13.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights without restriction.

13.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, pandemics, government actions, etc.).
